The CO.NO Operator seeks Norwegian court ruling to protect its customers

Fredrikstad/Amsterdam, October 25th 2011 –  Almost one year ago, the Sunrise period for CO.NO domain name reserved to IP rights holders opened. Three months later, January 31st 2011, this opening phase was successfully completed and every approved application was activated. However, contrary to the announced schedule, the Go Live period for .CO.NO registration had to be postponed.

As mentioned in a previous press release, the .CO.NO Operator took this difficult decision to ensure that everything was clarified with the .NO Registry and to offer its customers and registrars partners the best and most stable service.

“Because we strongly believe that our customers and partners deserve nothing less than total transparency, we have decided to disclose the reasons behind this delay” said Sander Scholten, the CO.NO Operator’s Manager.

As unambiguously mentioned on the .CO.NO Operator website (http://domain.co.no/gb/about.html), .CO.NO is a common initiative between Elineweb AS the registrant of the domain name and CoDNS BV, the technical backend provider. To maximize the chance of success of this initiative, Elineweb elected to benefit from CoDNS good reputation in the domain name industry and decided to promote this initiative under the business name .CO.NO Operator.

“We never tried to hide the fact that Elineweb is the registrant of the domain name, which is, besides a public information displayed in NORID whois database” commented Scholten.

Although NORID was informed of the intended use of the .CO.NO domain name, NORID elected to send a list of inquiries to the .CO.NO Operator several months after the beginning of the Sunrise period and just a few days before the opening of .CO.NO to the general public.

With a view to seek a sound understanding with NORID, the .CO.NO Operator decided to postpone the general opening of .CO.NO registrations.

Howbeit, It regrettably appeared that despite the thorough replies provided by the .CO.NO Operator, NORID sent a new series of inquiries, including amongst others, the disclosure of confidential information such as the .CO.NO initiative business plan.

It would later be very clear that NORID was trying to establish that the .CO.NO domain name had been somehow transferred from Elineweb to another entity, which would have given NORID grounds to invoke a breach of its own Domain name policy.

Nonetheless, resolved to find an amicable agreement with NORID, the .CO.NO Operator did everything they could to content NORID representatives by diligently replying to all of their questions, attending to phone conference and even meeting with NORID’s representatives in Oslo.

“We regret having to bring this matter to Court and would really have preferred that our efforts led to an amicable understanding, but NORID left us no other choice.” Scholten went on.

On the 26th of September 2011, Elineweb legal counsel Ræder DA started an action against NORID to seek a ruling from the Norwegian Court that will confirm their position and ensure the durability of the .CO.NO initiative.

“In the meanwhile we remain committed to offer a better choice to our Norwegian and International customers and the anticipation so far clearly shows we are on the right track. We would like to see NORID as a partner but we will not allow the public freedom of choice to be confiscated.”

Important news about the Go Live
Written by Sander SCHOLTEN
Monday, 21 February 2011
Tomorrow February 22nd was meant to be the launch date of our General Availability period for domain names ending in .Co.No after an extremely successful Sunrise dedicated to Trademarks.

Unfortunately and although we had taken every step to liaise with NORID for more than a year and worked hard to make sure .Co.No domains were managed according to the highest standards of quality and Internet stability, it does appear that the .No Registry has chosen the very eve of our launch to ask several more questions to us.

Since we want to offer our loyal customers and registrar partners the best and most stable service, we therefore had to take the difficult decision to postpone the launch for at least a month to ensure everything is clarified with Norid. We remain committed to offer a better choice to our Norwegian customers and the anticipation of our GA period clearly shows we are on the right track. We see Norid as partner but will not allow your freedom of choice to be confiscated.

See you in the 2nd quarter of 2011, we will keep you informed in the meantime and post the new dates as soon as possible.

Amsterdam, February 15th, 2011 – Following a successful Sunrise period, CoDNS is glad to announce the opening of the Go Live period, starting in 7 days, February the 22nd at exactly 2:00 pm GMT. Application requests can be made by the general public without any restriction or priority rights, and will be accepted on a first come, first served basis. As usual with .CO.NO extensions, a local presence in Norway is not required.

CoDNS has engendered great interest from brand owners, companies and individuals. Sander Scholten, Manager of CoDNS, comments, “We are delighted by the results we have achieved and people’s engaged response towards this new international extension. The .CO.NO is already seen as a successful alternative way to enter the Norwegian market and position a brand or a company as part of the international community. The Go Live period is an opportunity for anyone to do exactly that”.

CO.NO Sunrise Policy – Secure your Brands
Written by Sander SCHOLTEN
Wednesday, 27 October 2010

Amsterdam, 27 October 2010 – Following the much talked-about announcement of the .CO.NO domain, CoDNS is proud to present its finalized Sunrise policy. Central element of the policy is the protection of registered trademarks for an unprecedented competitive pricing: never before have trademark owners been able to participate in a “Sunrise” period at such low cost.

Trademark holders have already shown great enthusiasm in this new international extension that offers them better local visibility and additional flexibility. While Norwegian domain registrations can be perceived as restrictive, registrations under .CO.NO have no limitations, whether in the number of domains that can be registered per individual or company nor the demand for local presence.

Interview with Bart Lieben
Written by Sander SCHOLTEN
Thursday, 21 October 2010

.CO.NO is one of the first domain projects that embraces the ClearingHouse for Intellectual Property (“CHIP”) in the context of its launch process. In order to provide .CO.NO registrars with a better understanding, we have been talking to Bart Lieben, counsel with the law firm of Crowell & Moring and the principle architect of CHIP.

Q: What is CHIP?
Bart: CHIP is a revolutionary system and service aimed at assisting brand owners in securing and safeguarding their trademark rights on the Internet, and more in particular in the domain name space. CHIP intends to support brand owners in the context of a wide variety of rights protection mechanisms that are put in place by, for instance, domain name registries and policy-making bodies.
